This appeal from the dismissal, after trial without a jury, of a complaint alleging racial discrimination in employment practices presents two issues for our consideration: (1) whether the district court erred in determining that appellant Rices discharge from employment was based on cause and not on his race, which is Negro; and (2) whether the district court employed an erroneous legal standard in its determination that appellee, Gates Rubber Company, did not, after the effective date of Title VII of the Civil Rights Act of 1964, 42 U.S.C. Â§ 2000e et seq., discriminate against Negroes in job placement, transfer, promotion, demotion and discharge. We affirm that part of the district courts judgment dismissing appellants complaint in his own behalf but hold that it did not apply the correct legal standard in arriving at its determination in the class aspect of the action that appellee did not discriminate on the basis of race in its employment practices.
